Intellectual Property Law

Our firm offers services on Intellectual Property Law, such as registration of patents and trademarks.

Intellectual Property Law, is that area of law which concerns legal rights associated with creative effort of commercial reputation and goodwill. There are several forms of rights or areas of law giving rise to rights that together make up intellectual property. Such as:

  • Copyright
  • Rights in performances
  • The law of confidence
  • Patents
  • Registered designs
  • Unregistered design rights
  • Trademarks
  • Passing off
  • Malicious falsehood (trade libel).

Our expertise covers the registration of a trademark in respect of certain classes of goods or services. Registrations for Trademarks may be renewed indefinitely. According to the Law, the Registrar of Trademarks examines each application for conflicts with other trademarks. In case of conflict, the Registrar will notify the applicant and give him/her time to respond. If the trademark application is accepted, it will be sent for publication in the Official Gazette.

Further, our expertise covers the registration of a patent which gives you exclusive rights over your invention for a limited period. A patent may be granted in respect of a new and non-obvious invention capable of industrial application and gives a monopoly right. An application of a patent has to be drawn up precisely and accurately stating the scope of the invention and the claims made in respect of it for which protection is sought. The Intellectual and Industrial Property Division under the Department of Registrar of Companies and Official Receiver Office deals with the registration of patents and with the registration and protection of the patents granted by the European Patent Organization (EPO) and international patents under the Patent Cooperation Treaty (PCT).
